ASSUMPTION AND ACKNOWLEDGMENT OF RISKS RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

Our legal gurus said we have to let you (the Buyer) know some important stuff so here goes the legal information you need to know. Most of the below information pertains to the usage of the SCOUT365 Boats and also the Paddle Boards. Just remember, a little common sense goes along way.

Buyer fully acknowledges that using SCOUT inflatable products can be physically and sometimes mentally enduring. That certain hazards may exist at all times while aboard and or operating SCOUT inflatable products. Buyer acknowledges that while using SCOUT inflatable products, he/she is responsible for any damages that may occur to said SCOUT inflatable products and/or any personal or private property as a result of my negligence, decision making or reactions while operating SCOUT inflatable products. Buyer agrees to wear a U.S. Coast Guard or Canadian approved PFD (personal flotation device, life jacket) while riding SCOUT inflatable products, and will also require any passengers to wear a PFD. Buyer should be familiar with, and will comply with all rules and regulations for safe operation of the SCOUT inflatable products.

Furthermore, Buyer understands that he/she is will be operating watercraft in and around public waters and or government law enforcement areas. Customers will not hold Scout Inflatables LLC or its subsidiaries, departments, agents or employees responsible for death, injuries or any form of damages to private or public property.

Customers will not claim anyone but themselves responsible for any accident or incidents damages that may occur as the direct result of operational performance on these SCOUT inflatable products.

SCOUT inflatable products operator is liable for all Marine and Coast Guard violations. Operators are warned to pay strict attention to instructions and operate equipment in a safe manner. Passengers are advised to avoid distracting the attention of the operator while SCOUT inflatable products are in motion. It must be recognized that in operating or riding on any type of SCOUT inflatable product the operator and or passengers are assuming the risk, which may result in injury and or death.

Release

Recognizing that boating and watersports poses a potential hazard to others, buyer freely and willingly waives all claims to injury to himself or damage to purchased boat arising out of the improper use. Further, in consideration of the permission of use granted, buyer hereby release Scout Inflatables LLC, its directors, officers, representatives, agents, and employees from any and all liability for injury of any kind to buyer or to boat or other property buyer may have, incurred by reason of any act or failure to act, on buyer part, or Scout Inflatables LLC, its directors, officers, representatives, agents, and employees, arising because of the use of above mentioned SCOUT inflatable products.

Indemnification

Buyer further agree to indemnify and hold harmless Scout Inflatables LLC and its directors, officers, representatives, agents, and employees from all costs, suits, judgments, damages, or expenses, direct or indirect, for injury to other persons and/or their property, including, but not limited to, loss of use incurred by reason of act or failure to act on buyer part or by reason of any act, including negligence, of Scout Inflatables LLC directors, officers, representatives, agents, and employees, arising from the use of Scout Inflatable products. Buyers agree that litigation, if any, arising from the use of this product will be filed in the County of Orange, State of California, USA. This Release is made and entered into in the State of California, and shall in all respects be interpreted, enforced, and governed under the laws of the said State. Buyer recognizes that the provisions and terms recited herein above will cause Buyer to be personally liable for his/her act or failure to act during use of above mentioned inflatable products.   Scout Inflatables LLC reserves the right, at any time and without prior notice, to change or discontinue models, accessories, standard equipment and specifications for all boats and watercraft featured on this website. Specifications and weights are approximate and may vary from item to item. Some models featured in pictures may show optional equipment, some of which may not be available on standard models. Scout Inflatables LLC is not liable for any injury or mishap sustained by the use of these products. The user of this product acknowledges risks and waives any and all claims against Scout Inflatables LLC. and any of its agents.
